Egypt Criminal Record Check

## Source of criminal check data in Egypt Ministry of Interior ## Process in Egypt 1. The requesting party will request the check from the ATS or their Zinc account. 2. Automated instructions are delivered to the candidate to provide some personal details and a copy of their ID document in a dynamic web form. 3. Zinc submits the request to the authorities. 4. Zinc receives the results (digitally) and provides a signed digital report. 5. The candidate receives a text to say the process is complete. ## Details required to submit the check - First Name - Last Name - Birth Date - Consent - Address: Current or last known address in Egypt - Passport/ID Copy #### **For Citizens:** - Both sides of a valid National Egyptian ID or Egyptian Passport - The national number and address must be clearly stated #### **For Foreigners:** - A valid Copy of foreign passport ## What is covered in the criminal check The Criminal History Egypt verification has nationwide coverage, including citizens and foreigners over 18 years of age. The provision of the results is subject to the candidate’s explicit consent and is intended to serve one particular purpose indicated during the application process. The verification is requested and provided by the Ministry of Interior’s Public Security Department database and the General Directorate of Forensic Evidence Investigations. The reporting contains information on all the following criminal convictions or offences, except those deleted by rehabilitation laws or considered spent: - Offences against the constitution (e.g., electoral offences, corruption, trespass, etc.) - Misuse of public force - Offences committed by public servants - Offences against the public interest - Offences against the private interest - Offences against the public authority, influence, fraud, perversion of justice, refusal to assist justice - Disobedience to judicial orders - Obstruction of public service - Offences against state guarantees - Usurpation - Guarantee of the national economy - Felonies and misdemeanours against the general interest (e.g., public safety, offences against the public peace, public economy, public health, public decency, public worship) - Felonies and misdemeanours against the private interest (e.g., killing, harm, intentional force, private liberty, sexual offences, personal tranquility, confidence, property, insolvency, children, and family) - Simple offences Egyptian military service officers, police, diplomatic workers, and personnel in the Multinational Force and Observers zone are not covered by the verification due to the sensitivity and confidentiality of their work. The legal prescription of a sentence varies, depending on the type of offence committed and the sentence pronounced. According to the Egyptian Penal Code and relevant legislation, the following convictions are considered spent/minor offences: - Minor theft (Penal Code, Article 318) - Public disturbances (Penal Code, Article 278) - Minor vandalism (Penal Code, Article 162) - Simple traffic violations (Traffic Law, Articles 65 and 66) - Minor public nuisance (Penal Code, Article 278) - Trespassing without harm (Penal Code, Article 369) - Drunkenness in public (Penal Code, Article 374) - Minor assault resulting in no serious injury (Penal Code, Article 241) - Noise complaints (Penal Code, Article 277) - Littering and similar minor environmental violations (Environmental Law, Article 80) ## Restrictions, exclusions, limitations - In cases were the records found fall under the category of misdemeanours, it cannot be classified as a crime and will not be reported. - In cases of absentia, we will not report a case if there are no following convictions attached to it. - Following the Rehabilitation Law 39 (1975), amended under Law 49 (1982), the periods of rehabilitation differ between the offences (from 3 up to 15 years), but the data remains in the databases checked for 20 years. Spent conviction will not be reported. - Egyptian military service officers, police, and diplomatic workers, as well as personnel in the Multinational Force and Observers zone, are not covered by the verification due to the sensitivity and confidentiality of their work. ## Expected turnaround time Here. ## Period covered by the check The records are kept based on the legal prescription and rehabilitation periods applicable for each type of conviction provided by the local regulations in Egypt.
