## Who is the source of the criminal check data in Nigeria?

## What is the process in Nigeria?
The requesting party will request the check from the ATS or their Zinc account.
- Automated instructions are delivered to provide some personal details in a dynamic web form
- Zinc submits the request to the authorities
- Zinc received the results (digitally) and provides a signed digital report
- The candidate receives a notification from Zinc to say the process is completed
## What details are required to submit the check?
- First Name
- Last Name
- Birth Date
- Consent
- **Passport/ID Copy**
- For citizens:
- Copy of ID/Passport
- Copy of Residence permit
- Copy of driver license
- Copy of voter card
- Birth Certificate Copy accompanied by an ID/passport (valid or expired)
- Attestation of birth accompanied by an ID/passport (valid or expired)
- Copy of National Identification Number Slip (NINS)
- For foreigners:
- Copy of ID/Passport/valid Visa
- Copy of Residence permit
- Copy of driver license
- Copy of voter card
- Birth Certificate Copy accompanied by an ID/passport (valid or expired)
- Attestation of birth accompanied by an ID/passport (valid or expired)
- Government ID Copy (valid)
- If the candidate has an expired form of ID, he/she should present another ID in addition to the expired one. For example, a voter card or NIN can be added to the submitted ID as they have no expired date.
### If you can’t see an upload option for the ID you have
Sometimes the upload page only shows limited document types (for example: **Passport**, **Residence permit**, or **Driver’s license**) even though other IDs (such as **voter card** or **NINS/NIN slip**) are acceptable.
If this happens:
Select **Driver’s license** and upload your available accepted ID (for example, your **voter card** and/or **NINS/NIN slip**) in that upload slot so it can be submitted.
## What is covered in the criminal check?
This Criminal History Nigeria verification has nationwide coverage, including citizens and foreigners over 18 years of age. The provision of the results is subject to the candidate’s explicit consent and is intended to serve one particular purpose indicated during the application process.
The verification is requested and provided by the D'Dept Force CID Annex of Nigeria.
The reporting contains information on all the following criminal convictions or offences, except those deleted by rehabilitation laws or considered spent:
- offences relating to the currency
- offences relating to posts and telecommunications
- miscellaneous offences against public authority
- injurious acts to the public in general
- offences relating to religious worship offences against morality (e.g., indecent practices, conspiracy to defile, indecent acts, etc.)
- obscene publications
- nuisances
- gaming houses
- lotteries; misconduct related to corpses
- offences against public health
- rogues and vagabonds
- bringing contempt on the uniform
- assaults and violence to the person generally
- homicide
- suicide
- infanticide
- concealment of birth
- unlawful; offences endangering life or health assaults
- assaults on females
- abduction
- offences against liberty
- slave dealing
- offences related to marriage and parental rights and duties
- offences related to property and contracts
- stealing
- stealing with violence
- extortion by threats
- obtaining property by pretences
- cheating
- burglary
- housebreaking
- receiving property stolen or fraudulently obtained and like offences
- frauds by trustees and officers of companies and corporations
- false accounting
- forgery
- fraudulent debtors
- cruelty to animals
- miscellaneous offences concerning ships and wharves
- conspiracy
The legal prescription of a sentence varies, depending on the type of offence committed and the sentence pronounced.
According to the Criminal Procedure Act and Penal Code of Nigeria, the following convictions are considered spent/minor offences:
- Petty theft or shoplifting offences are regulated by Sections 390 402 of Nigeria's PenalCode, which outline the penalties and legal consequences for such acts
- Disturbances of the peace, including public disturbances or disorderly conduct, are governed by Sections 249 261 of Nigeria's Penal Code, which specify the legal provisions and penalties for such offences
- Minor vandalism, such as graffiti or minor property damage, falls under Sections 451 457 of Nigeria's Penal Code, which detail the legal provisions and consequences related to such acts of vandalism
- Minor traffic violations, such as speeding or illegal parking, are regulated by Sections 10 30 of the Nigeria Road Traffic Act, with specific sections detailing the rules of the road, traffic offences, and associated penalties
- Noise disturbances causing public annoyance or disturbance may be addressed under Sections 21 25 of the Nigeria Environmental Protection Agency Act, which outline the legal provisions and penalties for noise related offences
- Minor property disputes, involving low-value property or minor disagreements, are governed by Sections 1 51 of the Nigeria Land Use Act, with detailed provisions for resolving such disputes through mediation or arbitration

## Period covered by the check
The records are kept based on the legal prescription and rehabilitation periods applicable for each type of conviction provided by the local regulations in Nigeria. For accurate reporting purposes, cases from up to 7 years ago will be included in the report.
