## Who is the source of criminal check data in China? Courts and Tribunals of China ## What is the process in China? 1. The requesting party requests the check from the ATS or their Zinc account. 2. Automated instructions are delivered to provide personal details and their ID copy in a dynamic web form. 3. Zinc submits the request to the authorities. 4. Zinc receives the results digitally and provides a signed digital report. 5. The candidate receives a notification to confirm the process is complete. ## What details are required from the candidate to submit the check? - **First name** - **Last name** - **Birth date** - **Full name** - For citizens: must be in Chinese characters, as it appears on the identity document. - For foreigners: as it appears on the passport or any other identity document provided. - **Passport/ID copy** - For citizens: a copy of the PRC Resident Identity Card (居民身份证). - For foreigners: a copy of the passport (visa, work permit, or residence permit are also accepted). - Expired documents are accepted, since the copy is only used to run the search and cross-check results. - **Consent** ## What is covered in the criminal check? The Court Search Verification Process in Mainland China provides publicly available criminal judgments and convictions recorded by the People's Courts of the People's Republic of China, subject to the availability of records. The check has nationwide coverage, covering both citizens and foreigners. The verification includes publicly available criminal judgments issued by the following judicial authorities: - Supreme People's Court - Higher People's Courts - Intermediate People's Courts - Primary People's Courts The verification extends across all provincial-level administrative divisions of Mainland China, namely: Beijing, Tianjin, Shanghai, Chongqing, Anhui, Fujian, Gansu, Guangdong, Guangxi Zhuang Autonomous Region, Guizhou, Hainan, Hebei, Heilongjiang, Henan, Hubei, Hunan, Inner Mongolia Autonomous Region, Jiangsu, Jiangxi, Jilin, Liaoning, Ningxia Hui Autonomous Region, Qinghai, Shaanxi, Shandong, Shanxi, Sichuan, Tibet Autonomous Region, Xinjiang Uyghur Autonomous Region, Yunnan, and Zhejiang. This verification excludes the Hong Kong Special Administrative Region, the Macau Special Administrative Region, and Taiwan. Criminal cases may include, but are not limited to: - Crimes against national security - Crimes endangering public security - Corruption and bribery offences - Financial and economic crimes, including fraud, embezzlement, money laundering, tax-related offences, and illegal fundraising - Property offences, including theft, robbery, extortion, criminal damage, and fraud-related offences - Violent offences, including homicide, assault, kidnapping, unlawful detention, and bodily injury - Drug-related offences - Sexual offences - Cybercrime and telecommunications fraud - Public order offences - Other criminal offences under the Criminal Law of the People's Republic of China The following cases are generally excluded from the scope of the verification because they are not published on China Judgments Online or are otherwise restricted from publication: - Cases involving state secrets - Cases involving juvenile offenders - Criminal private prosecution cases resolved through mediation - Cases involving personal privacy or other legally protected confidential information - Other cases that the People's Courts determine are unsuitable for online publication in accordance with applicable laws and judicial rules, including cases involving national security, terrorism, or protected personal information The verification is limited to criminal matters and does not include civil, administrative, commercial, or family court proceedings. Certain cases may be excluded, removed, anonymised, or inaccessible due to privacy, national security, juvenile protection, or other legal reasons. - The availability of records is subject to publication by the relevant People's Court and the applicable publication rules of the Supreme People's Court. - Not all criminal judgments are published on China Judgments Online.
