## Who is the source of criminal check data in Vietnam? Supreme People's Court of Vietnam ## What is the process in Vietnam? 1. The requesting party will request the check from the ATS or their Zinc account. 2. Automated instructions are delivered to the candidate to provide some personal details in a dynamic web form. 3. Zinc submits the request to the authorities. 4. Zinc receives the results (digitally) and provides a signed digital report. 5. The candidate receives a notification to say the process is complete. ## What details are required from the candidate to submit the check? - First Name - Last Name - Birth Date - Full Subject's Name - For Citizens: With Vietnamese characters - For Foreigners: Vietnamese characters not required - Last registered address in Vietnam (temporary or permanent address) ## What is covered in the criminal check? The Court Search Vietnam provides criminal case information on citizens and foreigners legally residing in Vietnam, extracted through the online database of the Supreme People's Court of Vietnam. The information goes 7 years back and covers the following judicial bodies: - Supreme People's Court - High People's Court - People's Courts of provinces and centrally run cities - People's Courts of districts, towns, provincial cities, and equivalent - Military court Please note that this is a nationwide search and is not restricted to a specific locality. The address is required not for conducting the search itself, but rather as an additional identifier—used only when a second identifier is not available. In cases where search results, such as judgments, orders, or decrees, include the applicant's address, this information supports accurate matching and verification of the retrieved records. ## Restrictions, Exclusions, and Limitations - Due to privacy laws, there might be restrictions in accessing case information that the parties to the case have explicitly prohibited the public disclosure of. - The coverage of the search is national; however, please note that, in case the candidate has multiple addresses, separate checks must be submitted. - According to the Data Protection law applicable in Vietnam (Vietnam's Personal Data Protection Decree No. 13/2023/ND), there is a clause stating that searches cannot be resold without approval from the Supreme Court of Vietnam. However, since we used the open database of the Supreme People's Court of Vietnam to run the court search for criminal records, this falls outside the scope of that restriction. This database does not have the same reselling restrictions as private or restricted databases. Also, the information of the candidates is not being sold. - Please note that we only provide audit trails as evidence for this service.
