Scotland Criminal Record Check

## Who is the source of criminal check data in Scotland? Disclosure Scotland ## What is the process in Scotland? The requesting party will request the check from the ATS or their Zinc account. 1. Automated instructions are delivered to provide some personal details and complete a consent form in a dynamic web form. 2. Zinc submits the request to the authorities. 3. Zinc received the results (digitally) and provides a signed digital report. 4. Once the application is submitted and reviewed by the source, applicants will receive an **Online Certificate** via their Disclosure Scotland account, with a notification sent to their registered email address to create an account from Disclosure Scotland. This certificate can be viewed for 14 days once completed and can be shared with their employer if needed within this time window. After this time window, the certificate can no longer be shared by the candidate. - When Disclosure Scotland asks for an email address and phone number for you to share the Online Certificate/Disclosure, the candidate will need to enter the employer’s contact details (i.e., whoever they want to share the certificate with). - Candidates do not need to forward/share the Online Certificate to Zinc through this process, as the results are received via our provider checking this system directly. 5. When the certificate has been received and reviewed by Zinc, the candidate receives a notification from Zinc to say the process is completed. ## What details are required to submit the check? - First Name - Last Name - Birth Date - Nationality - Place of Birth (exact city/town of birth) - Passport/ID Copy - Driving license, birth certificate, and expired ID are also acceptable - Passport Country - Mother's Maiden Name - 5 years of address history with start and end dates (month and year) - Proof of address: Driving license, utility bill, or bank statement which are less than 12 months old - **Specific Consent Form** - Candidates will need to provide their information where indicated in the **Applicant Information** section - For the **Employer Information** section, candidates will need to provide the full address for the employer's location where indicated. This will be the company's registered address if they are working remotely. - For the question **Is the regulated workplace/remote workplace in Scotland?**, this is a yes/no question and is asking if where the candidate is physically or remotely working is in Scotland. **If they are working in Scotland, they need to answer this question as yes, it is irrelevant where the company is based.** - Digital signatures or wet signed (with a pen) signatures are acceptable. All digital signatures are accepted **except a typed name** - Candidate's Active Email Address - Consent ## What is covered in the criminal check? The copy of the Level 1 Disclosure Certificate issued by Disclosure Scotland has nationwide coverage and applies to citizens and foreigners over 18 years of age who live or work in Scotland. The provision of results is subject to the candidate’s explicit consent and is intended to serve the specific pre-employment purpose indicated during the application process. Disclosure Scotland reserves the right to issue or deny the certificate after carefully assessing the nature of the request. The certificate includes information on the following criminal convictions or offences, except those removed under rehabilitation laws or considered spent: - Offences against the constitution (e.g., electoral offences, corruption, trespassing, etc.) - Misuse of public force Offences committed by public servants - Offences against the public interest - Offences against private interests - Offences against public authority, including influence, fraud, perversion of justice, and refusal to assist justice - Disobedience to judicial orders - Obstruction of public service - Offences against state guarantees - Usurpation - Violations affecting the national economy - Felonies and misdemeanours against the general interest (e.g., public safety, offences against public peace, public economy, public health, public decency, public worship) - Felonies and misdemeanours against private interests (e.g., homicide, bodily harm, intentional force, violations of personal liberty, sexual offences, breaches of personal tranquility, fraud, property crimes, insolvency-related offences, and offences affecting children and families) - Minor offenses The legal prescription of a sentence varies, depending on the type of offence committed and the sentence pronounced. The Certificate is valid for a period of 6 months from the issuance date. ## What is the expected turnaround time?
