Serbia Criminal Record Check Process and Requirements
## Who is the source of criminal check data in Serbia?
Ministry of Interior of the Republic of Serbia.
## What is the process in Serbia?
The requesting party will request the check from the ATS or their Zinc account.
- Automated instructions are delivered to the candidate to provide some personal details in a dynamic web form
- Zinc submits the request to the authorities
- Zinc receives the results (digitally) and provides a signed digital report
- The candidate receives a notification to say the process is complete
## What details are required from the candidate to submit the check?
- First Name
- Last Name
- Date of Birth
- Consent
- **Power of Attorney (POA)**
- POA can be signed with a wet signature or electronically. A scanned copy is sufficient. No notarisation is required.
- **Address**
- Last registered address in Serbia
- **Passport/ID Copy**
- **For Citizens**: Serbian ID Card copy or Serbian Passport copy
- **For Foreigners**: Foreign Passport copy or copy of the Serbian ID card for foreigners or Serbian Residence Permit copy (either permanent or temporary)
- Electronic ID cards are also acceptable. Expired IDs are also acceptable.
## What is covered in the criminal check?
The Criminal History Serbia verification has nationwide coverage, including citizens and foreigners over 18 years of age. The provision of the results is subject to the candidate’s explicit consent which is performed through a POA and is intended to serve one particular purpose indicated during the application process.
The verification is requested and provided by our in-country Partner who will visit the Ministry of Internal Affairs, local courts and High Court of the Republic of Serbia. Our Partner has been thoroughly vetted according to our highest Partner Management policies and compliance standards.
The reporting contains information on all the following criminal convictions or offences, except those deleted by rehabilitation laws or considered spent:
- Offences against life and limb (e.g., murder, manslaughter in the heat of passion, infanticide, illegal termination of pregnancy, serious bodily harm, light bodily injury, endangerment, etc.)
- Criminal offences against freedoms and rights of man and citizen (e.g., violation of equality, violation of the freedom of religion, etc.)
- Criminal offences against electoral rights
- Criminal offences against labor rights
- Criminal offences against honour and reputation (e.g., insult, defamation, etc.)
- Sexual offences
- Offences relating to marriage and family
- Offences against property (e.g., burglary, robbery, theft, and handling of stolen goods)
- Offences against economic interests
- Offences against human health
- Criminal offences against the environment
- Criminal offences against the general safety of people and property
- Criminal offences against road traffic safety
- Criminal offence against the security of computer data
- Criminal offences against the national coverage
The legal prescription of a sentence varies, depending on the type of offence committed and the sentence pronounced.
According to the Criminal Code and the Law on Misdemeanours of the Republic of Serbia, the following convictions are considered spent/minor offences:
- Petty theft or shoplifting, involving the unauthorised taking of property valued at less than 15,000 Serbian dinars, is regulated by Article 210, Paragraph 1 of the Criminal Code. This section classifies such thefts as minor offences, which may result in fines, community service, or a short-term imprisonment, and these convictions are typically considered spent after a defined period without further offences.
- Disturbances of the peace, such as public disturbances or disorderly conduct, are addressed under Article 343, Paragraph 1 of the Criminal Code. These offences are usually deemed minor when they do not involve significant violence and result in penalties like fines or short-term imprisonment, which can be considered spent after complying with legal requirements and avoiding recurrence.
- Minor vandalism, including acts like graffiti or causing minor property damage, is covered under Article 212, Paragraph 1 of the Criminal Code. This section deals with vandalism that results in minor damage, leading to penalties such as fines or short-term detention, which are considered minor and can be spent over time once the legal conditions are met.
- Minor traffic violations, such as speeding below a specific threshold, illegal parking, or minor infractions of traffic rules, are regulated by Articles 330 to 340 of the Law on Road Traffic Safety. These sections cover a range of minor traffic offences, often resulting in fines or brief license suspensions, which are classified as minor and can be considered spent after fulfilling the penalties and maintaining a clean record.
- Noise disturbances causing public nuisance or disturbance are addressed under Article 8, Paragraph 1 of the Law on Public Order and Peace. This section regulates excessive noise and disturbances, leading to fines or warnings, which are regarded as minor offences and can be considered spent following a period of compliance without further violations.
- Minor property disputes, involving low value property or minor disagreements, are governed by Articles 115 to 125 of the Civil Code. These articles cover various aspects of property rights and disputes, which are generally resolved through civil proceedings and are considered minor if they involve low stakes and result in settlements or minor penalties that can be considered spent over time.

## Period covered by the check
The records are kept for an indefinite period, based on the legal prescription and rehabilitation periods applicable for each type of conviction provided by the local regulations of Serbia. For accurate reporting purposes, cases from up to 7 years ago will be included in the report.
